Conditions of sale

The owner of the online shop electrarattad.ee (hereinafter referred to as the Online Shop) is OÜ Kvaliteettehnika (registration code 12239479), located at Kadaka tee 84a, Tallinn.

Validity of the sales contract, commercial and price information

The terms and conditions of sale apply to the purchase of goods from the Online Shop. The prices of products sold in the Online Shop are indicated with the products. The price is subject to a delivery charge. The delivery charge depends on the location of the buyer and the delivery method. The delivery charge is displayed to the buyer when placing the order. Information about the goods is provided on the Online Shop directly next to the goods.

Placing an order

To order, you must add the products you want to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the fee will then be displayed on the screen, which can be paid via online banking or other payment methods. The contract will enter into force as soon as the amount due has been credited to the account of the Webshop. In the event that the goods ordered cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but not later than 14 days after the notification.

Delivery to

Goods are shipped only to Estonia. The shipping costs are borne by the buyer and the corresponding price information is displayed with the shipping method. Shipments within Estonia usually arrive at the destination specified by the buyer within 2-7 working days from the entry into force of the sales contract. In exceptional cases, the right of delivery is granted up to 45 calendar days.

Right of withdrawal

After receipt of the order, the buyer has the right to withdraw from the e-contract within 14 days. The right of withdrawal does not apply if the buyer is a legal person. In order to exercise the right of withdrawal within 14 days, the goods ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods, in the same way as is allowed for testing the goods in a physical shop. If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of use or wear, the Online Shop shall be entitled to reduce the refundable amount in accordance with the reduction in the value of the goods. In order to return the goods, a declaration of withdrawal from the purchase of the goods must be submitted and sent to the e-mail address electra@electrarattad.ee no later than 14 days after receipt of the goods. The cost of returning the goods is borne by the purchaser, unless the reason for returning the goods is that the goods to be returned do not correspond to what was ordered (e.g. wrong or defective goods). The purchaser must return the goods within 14 days of the date of the application or provide proof that he has handed them over to the carrier within the aforementioned period. Upon receipt of the goods to be returned, the online shop will reimburse to the purchaser immediately, but not later than 14 days after receipt of the request for withdrawal, all payments received from the purchaser under the contract. The online shop may refuse to make refunds until it has received the return of the goods that are the subject of the contract or until the buyer has provided proof that it has returned the goods, whichever is the earlier. If the purchaser has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method. The online shop has the right to withdraw from the sale and to demand the return of the goods from the purchaser if the price of the goods in the online shop is, due to a mistake, marked significantly below the market price of the goods.

Right to lodge a complaint

The online shop is liable for the non-conformity or defect of the goods sold to the buyer, which already existed at the time of delivery and which will become apparent within a maximum of two years from the delivery of the goods to the buyer. During this first six months after the delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption. In the event of a defect, the Buyer has the right to contact the Webshop within two months at the latest by sending an e-mail to electra@electrarattad.ee or by calling 5093687. The online shop is not liable for defects that occur after the delivery of the goods to the buyer. In the event that the goods purchased from the Webshop have defects for which the Webshop is liable, the Webshop will repair or replace the defective goods. In the event that the goods cannot be repaired or replaced, the Online shop will refund the buyer all the fees that were included in the sales contract. The online shop shall respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online shop uses the personal data entered by the buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer. The online shop forwards personal data to companies providing transport services in order to deliver the goods. The online shop sends newsletters and offers to the buyer’s e-mail address only if the buyer has expressed his/her wish to receive them by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications. The purchaser may opt-out of receiving offers and newsletters by e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

Dispute resolution

If the purchaser has any complaints about the Online Shop, they should be sent by e-mail to electra@electrarattad.ee or by telephone to 5093687. If the buyer and the Online Shop cannot settle the dispute through an agreement, the buyer can turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between the buyer and the online shop. The examination of the buyer’s complaint by the Commission is free of charge. The buyer may refer to the European Union’s consumer dispute resolution platform.

Cookie usage and privacy policy notice

This Cookie Notice and Privacy Policy Notice (hereinafter the Notice) contains useful information about how and for what purpose OÜ Kvaliteettehnika collects, processes and shares personal information (data). The Privacy Policy is based on the General Data Protection Regulation (GDPR). The purpose of the Privacy Policy is to protect the privacy of our customers in accordance with the laws of the Republic of Estonia and the legislation of the European Union. “Personal Data” means any information about an identified or identifiable natural person, such as name, address, email address, and information about visits to our website, social media channels and use of our services. By using our website, you agree to the use of cookies and the terms and conditions of the processing of personal data as described in our Cookie Usage and Privacy Policy. Effective from 1.05.2023

1. Whose data does OÜ Kvaliteettehnika process?

OÜ Kvaliteettehnika is the controller of personal data and in case of any questions please contact electra@electrarattad.ee OÜ Kvaliteettehnika processes the data of its customers and contact persons who have made a purchase from our e-shop or have used our services. In certain cases, we process personal data that is available from public sources.

2. Purposes and legal basis for the processing of personal data (personal information) of the customer.

We process personal data of voluntary users of our marketing channels and users of our services and customers (including customer representatives) in order to fulfil our contractual obligations and to provide potential customers with better service and information. Where OÜ Kvaliteettechnika processes personal data for these purposes, the legal basis for the processing is our legitimate interest in ensuring the correct and high quality provision of our products and services. From OÜ Kvaliteettehnika’s marketing channels (including the website), we collect data about their use and the interests of potential customers in order to better understand the actual interests of our customers, to provide better quality information and to improve the functionality and user-friendliness of the website. In this case, the legal basis for the processing is our legitimate interest to better understand our customers’ needs and to provide better services and products. For example, OÜ Kvaliteettechnikika processes data on customer purchasing behaviour, data on reading and opening newsletters and data on opening advertisements in order to provide customers with their preferred offers and content. OÜ Kvaliteettehnika processes personal data for the following purposes: building and managing the customer base; offering new products to the customer; offering new services to the customer; analysing and improving services; analysing and improving the e-shop; managing the website; fulfilling legal requirements; responding to customer requests; delivering products.

3. How the data is collected

We generally collect personal data directly from data subjects and with their consent. In addition, we use automated data collection tools, including cookies and other tracking tools, to optimise the user experience of our e-shop and to provide better services and products to our customers. More specifically, OÜ Kvaliteettechnikika uses: analytical cookies, which collect information about how the website is used. For example, which content pages are visited the most, or what visitors search for on the website, etc. These cookies do not collect any information that would directly identify a website user. This includes, for example, Google Analytics and Hotjar cookies, advertising cookies that help to serve ads targeted to the user’s interests. For example, the electrarattad.ee page has a Facebook pixel code and if you no longer wish to see ads from OÜ Kvaliteettehnika’s websites on Facebook, you can disable them. Location maps and videos will not be shown unless you have agreed to the privacy policy. To make this technically possible, we use the privacy_embeds cookie created by Open Design. 4. Personal data processed by OÜ Kvaliteettehnika (including data).

OÜ Kvaliteettechnikika may process the following personal data (including data): contact data – name, e-mail address and phone number automatically collected data – data collected from the user’s web browser, including browser type, device type, communication language, website address, where the user came from, which content pages the user browsed and the user’s IP address and other traffic data. Other personal information – that you have made publicly available or made available to us on third party social networking sites such as LinkedIn, Facebook, Instagram, etc., or that you have made publicly available to us on third party social networking sites such as LinkedIn, Facebook, Instagram, etc., and any other personal information that you have made publicly available or made available to us. As a data controller, OÜ Quality Engineering does not process special categories of personal data.

5. Sharing personal data

OÜ Kvaliteettehnika does not transfer customer data outside the European (EU) Economic Area. OÜ Kvaliteettehnika does not share the customer’s personal data with third parties except under the conditions listed below. All data will be used for communication purposes only and for the purpose of providing a better product or service. We may share your personal information with the following. 6. Security, use and retention of personal data (data)

OÜ Kvaliteettechnikika may send customers information about its services, products, newsletters and offers if the customer has provided us with his/her contact details, but only until the customer has requested to discontinue recent activities or has left the group of newsletter recipients. 6.1. The Customer has the right of access to the Customer’s personal data processed by OÜ Kvaliteettechnika and the right to request the correction of inaccurate personal data. If the Customer has any questions regarding his/her rights or if he/she believes that OÜ Kvaliteettehnika has violated his/her rights in the processing of his/her personal data (data), he/she should contact OÜ Kvaliteettehnika by e-mail at electra@electrarattad.ee. If you do not wish to receive marketing communications from OÜ Kvaliteettechnikika, you may opt-out by following the opt-out instructions at the bottom of each marketing communication or by contacting us via our contact page. Data subject rights Right of rectification – is the right of a data subject to have inaccurate personal data relating to him or her rectified without undue delay. Right of erasure – is the right of a data subject to obtain the erasure of his or her personal data without undue delay, provided that certain additional conditions are met. In certain cases, data subjects have the right to restrict the processing of their personal data. The data subject has the right of access to the personal data that we hold about him or her and that he or she has provided to us and the right to transmit that data to another controller, where technically feasible and where the processing is based on consent or contract and is automated. The data subject has the right to object at any time, on grounds relating to his or her particular situation, to processing of his or her personal data carried out on the basis of the relevant provisions of the legislation, including profiling carried out on the basis of those provisions. Subject to the law, the data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or significantly affects him or her. Where the processing of personal data is based on the data subject’s consent, the data subject shall have the right to withdraw his or her consent at any time, without prejudice to the lawfulness of the processing based on consent prior to its withdrawal. 8. Other provisions

OÜ Kvaliteettehnika reserves the right to unilaterally change the use of cookies and the privacy policy. The latest version of the Cookie Usage and Privacy Policy will always be available on this website. The laws of the Republic of Estonia apply to this Cookie Policy and Privacy Policy. Any disputes or claims arising out of this policy shall be settled in Tallinn Harju County Court.
